California Sexual Harassment Training Requirements

California employers with 5 or more employees are mandated by Government Code section 12950.1 to provide sexual harassment and abusive conduct prevention training every two years. Non-supervisory employees must undergo 1 hour of training, while supervisors require 2 hours. The upcoming deadline for compliance is January 1, 2023. This obligation extends to California-based employees, even if they work in different locations or reside outside the state. Connecticut Sexual Harassment Prevention Training Updates

Executive Order 7DDD, amended by Executive Order 11, has extended Connecticut’s Oct. 1st Sexual Harassment Prevention Training deadline to May 20, 2021, due to the Covid-19 pandemic. This blanket extension eliminates the need for formal requests and is designed to accommodate pandemic-related challenges. Enacted in 2019, the Time’s Up Act imposes new sexual harassment training rules for employers with three or more employees, including mandatory training sessions and the provision of information to new hires. Combatting Sexual Harassment: Delaware Discrimination in Employment Act (DDEA)

Sexual harassment, identified as a form of sex discrimination, is strictly prohibited under the Delaware Discrimination in Employment Act (DDEA), applicable to employers with a workforce of 4 or more employees, including state and local governments, employment agencies, and labor organizations. Prevention is emphasized, urging employers to communicate a zero-tolerance stance on sexual harassment, provide comprehensive training, establish effective complaint procedures, and promptly address concerns. Retaliation against those opposing discriminatory practices or participating in investigations is expressly prohibited under the DDEA, reinforcing the commitment to fostering safe and respectful workplaces. Illinois Sexual Harassment Prevention Training Requirements

A recent amendment to the Illinois Human Rights Act (IHRA) through Public Act 101-0221 mandates that Illinois employers provide annual sexual harassment prevention training by December 31, 2020, and subsequently on an annual basis. This law further requires restaurants and bars to establish and disseminate a written policy on sexual harassment prevention training, along with providing “supplemental” sexual harassment prevention training. New York Sexual Harassment Prevention Training Requirements

New York State law mandates employers with one or more employees to conduct annual sexual harassment prevention training for all staff. In addition, New York City imposes its own training requirements, with employers obligated to maintain training records for three years.  All New York employers are required to have a sexual harassment prevention policy, and the State Department of Labor offers a model policy for reference. Workplace Sexual Harassment Regulations in Maine

In accordance with the Delaware Discrimination in Employment Act (DDEA), employers are obligated to take specific actions to maintain workplaces free of sexual harassment. For workplaces with 15 or more employees, mandatory education and training programs are required for new employees within the first year of employment, addressing legal standards, complaint processes, and prevention measures. Supervisory and managerial staff must undergo additional training.  Non-compliance may result in fines assessed by the department, with escalating penalties for subsequent violations. Sexual Harassment Training Regulations 

There are now strict state laws in California, Connecticut, Delaware, Illinois, Maine, and New York that require employers to provide sexual harassment training, including:

  • New supervisor training within six months of promotion
